New Year, Same Tendency to Scam People | DayRiffer

?

Once upon a time, con men helped people part with their money on Mississippi riverboats. Or sold some kind of ?snake oil? ? a supposed cure-all that actually didn?t do anything. We can?t forget Charles Ponzi, the skeezball who helped to popularize the pyramid scheme successfully enough (for a time) that his name gave birth to his own eponymous scheme. (Come to think of it, the building of the Pyramids is one of the great scams of all time, but since some of the actual builders were slaves, it?s hard to suggest they got conned into giving up their time and lives.)

More recently, our scams have included email pleas from alleged Kenyan businessmen to help them get millions out of some bank, in return for a hefty fee; ?brokers? who ?pump and dump? stocks; identity theft; hacking and viruses; doctors practicing without a license. New era, same tendency to manipulate and steal from the unsuspecting.

According to NBC News, a new survey conducted by consumer advocacy groups (Consumer Federation of America and the North American Consumer Protection Investigators) lists the fastest-growing consumer complaints, including ?debt collection abuses, Do Not Call list violations, mortgage-related problems and home improvement scams.? Also, ?a set of real estate related complaints cracked the top 10 for the first time covering issues with timeshare sales and resales, retirement and assisted living facilities and real estate fraud.?

According to the story, "In Florida, the state's Department of Agriculture and Consumer Services said bogus 'free energy audit' solicitation phone calls were among the fastest-growing Do Not Call violation complaints. Callers often falsely claimed that because the audit was free, the call was not subject to the restrictions of the Do Not Call law."

Here are the top 10 consumer complaints from this year?s survey:

?1. Auto: Misrepresentations in advertising or sales of new and used cars, lemons, faulty repairs, leasing and towing disputes.
2. Credit/Debt: Billing and fee disputes, mortgage modifications and mortgage-related fraud, credit repair, debt relief services, predatory lending, illegal or abusive debt collection tactics.
3. Home Improvement/Construction: Shoddy work, failure to start or complete the job.
4. Retail Sales: False advertising and other deceptive practices, defective merchandise, problems with rebates, coupons, gift cards and gift certificates, failure to deliver.
5. Utilities: Service problems or billing disputes with phone, cable, satellite, Internet, electric and gas service.
6. Services: Misrepresentations, shoddy work, failure to have required licenses, failure to perform.
7. Internet Sales: Misrepresentations or other deceptive practice, failure to deliver online purchases.
7. Landlord/Tenant: Unhealthy or unsafe conditions, failure to make repairs or provide promised amenities, deposit and rent disputes, illegal eviction tactics.
8. Fraud: Bogus sweepstakes and lotteries, work-at-home schemes, grant offers, fake check scams, the ?grandparent scam? and other common frauds.
9. Real Estate: Timeshare sales and resales, retirement communities and assisted living facilities, real estate fraud.
10. Household Goods: Misrepresentations, failure to deliver, faulty repairs in connection with furniture or appliances; Home Solicitations
10. Misrepresentations: Failure to deliver in door-to-door, telemarketing or mail solicitations, do-not-call violations.?

Stories like this, about people like this, are bound to make us even more cynical. Is no one to be trusted? One of the few organizations with unimpeachable credibility among American consumers ? for generations ? is Consumers Union, the people who produce Consumer Reports. While they evaluate products more often than services, it can?t hurt to check out their recommendations before you?re about to put real money down on anything.

September iPhone 5 release helps explain Apple?s weaker Q4 revenue and gross margin guidance

September iPhone 5 release helps explain Apple?s weaker Q4 revenue and gross margin guidance

Yesterday, iMore broke the news that Apple would be holding a special event on September 12th, with a release of the iPhone 5 on September 21st. Most other major websites and news services have now reported on this too.

I think this new information really helps to explain the financial guidance that Apple provided to Wall Street on its conference call last week. In case you missed it, check out the summary I wrote about Apple?s Q3 results.

Here?s the short version: Apple told the Street that Q4 (September quarter) revenue will be down 4% sequentially (i.e. compared to the June quarter). But the kicker was gross margin guidance. Apple told analysts to expect only 38.5% gross margin compared to more than 42% in the most recent quarter. This resulted in a stock sell-off, with Apple shares declining by more than 5% in after-market trading on the night of the release.

I pointed out last week that Apple has sung this song before. Last year they guided down (on margin) for the September quarter only to come in significantly ahead of guidance. Apple is notorious for giving lowball guidance.

Gross margin effect of the new iPhone

Last year, we couldn?t blame the iPhone 4S launch on a margin hit to the September quarter. Why? Because it launched in October. The only hit to margins in the September quarter last year came from the back to school promos and volume reduction due to anticipation for a new iPhone launch in October. When companies sell less hardware, they lose some of their leverage. So margin goes down.

But this year? It?s now shaping up to be a totally different story. If Apple announces the new iPhone on September 12, and starts selling them on the 21st, then this new blockbuster product will have a massive effect on the current quarter. It may only be a few weeks of difference, but to Wall Street, it?s important because it dramatically affect the comparison to last year.

Wells Fargo analyst, Maynard Um, wrote about Apple?s huge prepayment for inventory in Q3. Buying inventory doesn?t affect gross margin in the period that you buy it. But it does affect margins when you sell that inventory in the form of finished goods (the shiny new iPhone 5). That?s because in accounting, you record costs associated to products at the time of sale, not at the time of inventory purchase.

So when Apple starts shipping its new phone on September 21st, it will book revenue and record the cost of sales based on the cost of this new inventory. Because the iPhone 5 is expected to have LTE, a bigger and higher-tech screen, faster processor, and lots of other improvements, the components will cost more. Yet the price point (what Apple charges the carrier) may not change significantly. As a result, gross margin declines.

The timing of this year?s launch makes Apple?s guidance to Wall Street much more believable this year.

Will Apple regain its gross margin?

A lot of investors and analysts are wondering if Apple will regain its lost gross margin, assuming that they do report something in the high 30s for the September quarter. While the analyst community often obsesses over percentages, I think gross margin dollars are much more important. But before I get into that, let?s look at how margins are affected by product launches.

I already explained how new products can hurt margins because of more expensive components. But another factor to consider is the price reduction of older products. If Apple drops the price of the iPhone 4S by $100 (making it the new low-cost iPhone), this affects margin. And it?s a step change down, because Apple flips the switch on the price tag instantaneously.

How does the company recover from this? I?m not an expert in Apple?s supply chain practices, but I do know it?s quite common for OEMs to negotiate price reductions into supply agreements over the life of a product. I would guess Apple does this too. So whatever they pay for an iPhone 5 component in the September quarter might be higher than what they pay in December, March, and onwards. As long as Apple can hold onto its retail price while cutting the cost of its bill of materials, margin climbs.

Volume also matters, though. I?d argue that the iPhone 4S is a darn capable phone. At $99 on a contract, it will probably sell extremely well. We?ve seen this before. Most recently, when the new iPad launched, the iPad2 price was cut to $399. Apple acknowledged that this is hurting margins. But who cares? The iPad volumes are through the roof. Apple is spectacularly profiting from this move.

This brings me back to my original point about gross margin dollars versus percentage points. Would you rather see Apple sell 50 million iPhones at 38% margins, or sell only 40 million phones at 42% margin? Do the math. Shareholders make more money in the former scenario.

I?ll take the money, thanks.

Speaking of volume

While we?re talking about volume, it wouldn?t seem right to close off this article without mentioning Apple?s market share gains. Research firm Strategy Analytics reported some interesting numbers this week. According to their study, US smartphone sales actually declined by 5% in calendar Q2, compared to the prior year?s quarter. Shipments were 23.8 million instead of last year?s 25.2 million.

Here?s the bullish part for Apple: They were the only platform to show growth. Yup. Android volume declined 12%. BlackBerry volume declined 41%. But the mighty Apple? They expanded by a whopping 34%.

The total US smartphone market seems to be maturing, given the year over year decline in volume. But Apple still sits far behind Android in terms of market share, so it will be interesting to see how competitive Apple gets in order to make sure they don?t leave a ?price umbrella? for competitors.

Perhaps a lower cost iPad mini is just the beginning?

Khairi Fortt Leaving Penn State: Linebacker Headed To California In Wake Of NCAA Sanctions

STATE COLLEGE, Pa. ? Penn State's loss could turn into a big gain for Southern California.

Star tailback Silas Redd bolted Happy Valley for Los Angeles in a season of great expectations for the Trojans. A 1,200-yard rusher, Redd will join heralded quarterback Matt Barkley on a team already favored to win the Pac-12 and return to the Rose Bowl.

It's a perk that Redd wouldn't have enjoyed at Penn State with the program burdened by harsh NCAA sanctions because of the Jerry Sandusky child sex abuse scandal. Among the penalties was a four-year postseason ban, as well as a scholarship reduction.

Another Pac-12 school also took in a Nittany Lion on Wednesday as top reserve linebacker Khairi Fortt said he was transferring to California. Fortt, like Redd, is from Connecticut, and both players will have two years of eligibility left.

Fortt said in a statement issued through his father, Guy Fortt, that he reached a point in his life in which he "was ready for a change," and that he had also seriously considered Cal in high school. The Stamford Advocate first reported Fortt's decision.

"He will miss Penn State," Guy Fortt said.

In light of the sanctions, the NCAA is allowing Nittany Lion players to seek new schools and play immediately, so long as they leave by the start of Penn State training camp next Monday.

Since the sanctions were imposed last week, Nittany Lions coach Bill O'Brien has been trying to keep the team intact by stressing academics, family and the prospect of playing seven home games a year in front of a crowd of 108,000 strong at Beaver Stadium.

For the most part, it seems to have worked ? even though Redd's departure will be a serious blow to an offense being reconfigured by O'Brien, the former coordinator of the New England Patriots' high-powered attack.

Four players have now left Penn State since the NCAA imposed its landmark penalties on July 23. A fifth player, third-string quarterback Rob Bolden, was removed from the roster this week but had been granted permission to talk to other schools before the sanctions. Bolden, who fell out of favor with two coaching staffs at Penn State, drew heavy interest from LSU, and on Wednesday, Tigers coach Les Miles confirmed the quarterback has made the transfer official.

Miles said Bolden "is talented and will be given every opportunity to compete."

Otherwise, Redd and Fortt are the ones who logged significant playing time leaving Penn State. At least so far.

O'Brien had also said last week at Big Ten media days that more than 50 players had indicated they would stay. Six 2013 recruits have also reaffirmed their verbal commitments.

The community has been doing its part as well. An early-morning rally on Tuesday attracted more than 2,500 fans who cheered on their team as walked into a voluntary, offseason workout.

Penn State athletic director Dave Joyner wished Redd and the other transfers well. "I think that certainly we understand and it's within their purview," Joyner said in an interview with The Associated Press.

He added the low number of transfers was "a great testament to Bill O'Brien, and the kind of person he is, the kind of coach he is and the kind of players these are overall.

"This team has a lot of unity."

But it won't have Redd.

Sophomore Bill Belton, a converted wideout, is next on the Penn State depth chart, and that could prove to be a challenge as O'Brien tries to transform the offense on the fly.

Out west, Redd joins a team that finished 10-2 and No. 6 in the final AP poll last season despite its own NCAA sanctions ? bowl ineligibility and a smaller roster. After Barkley and safety T.J. McDonald decided in December to return for their senior years, USC signed a top-flight recruiting class led by elite quarterback prospect Max Browne.

Redd could make the Trojans even better.

"We welcome Silas Redd to the Trojan Family," USC athletic director Pat Haden said in a statement. "He is an outstanding student and athlete."

USC had been sanctioned for rules violations committed during the 2004 and `05 seasons.

"At USC, we've seen both sides of this issue, having lost a number of players to transfer due to our NCAA sanctions in 2010. But Lane Kiffin and his coaches would not be doing their job if they did not try to improve our team every single day," Haden said. "There is a specific need here for a player like Silas Redd, so Lane and our coaches recruited him within the guidelines set up in this instance by the NCAA."

Fortt wore No. 11 at Penn State ? a distinction at a program that boasts the nickname "Linebacker U." Former Redskins standout LaVar Arrington and current 49ers linebacker Navorro Bowman each wore the number at Penn State.

Fortt had surgery this spring on his right kneecap. Guy Fortt said it's possible that his son may redshirt this season at Cal, a school that Fortt liked during a high school recruiting visit.

Highly regarded out of high school, Fortt made 11 tackles in his only career start, as a freshman. He had 33 tackles and 2.5 sacks while playing in every game last season as a top backup.

New Jersey lawmakers approve judicial pension measure

(Reuters) - New Jersey lawmakers voted on Monday to change the state constitution, in a swift retort to a decision by the state's Supreme Court that judges were exempt from last year's pension reform.

The resounding bi-partisan approval by both houses of the legislature allows the measure to be put before voters in November.

If approved by voters, the change would clarify that the legislature has the authority to pass laws that take amounts from judges' salaries to put toward their benefits.

"This is not about penalizing judges," New Jersey Assembly Speaker Sheila Oliver said in a statement. "Public approval of this ballot measure will ensure that everyone contributes equally to a fiscally responsible plan that will help shore up our pension systems."

Across the United States, most states are in some stage of reforming their public pension systems after years of underfunding, poor investment returns and growing liabilities have left them with an estimated collective shortfall of $1.38 trillion.

New Jersey, like other states, has more than one pension fund, including one that is only for its judges and justices.

Democratic state senators said on Monday that the judicial pension fund has about $280.5 million less than it needs to pay out to current and future retirees.

The fund has 52 percent of the money it should contain, making it the "most unstable" of New Jersey's pension funds, the senators said.

On July 24, New Jersey Supreme Court justices ruled in a split decision that a 2011 law -- which called for public employees in the state to increase their pension and healthcare contributions -- violated the New Jersey constitution as ratified in 1947.

The reform amounted to a change in judges' salaries, which are supposed to be protected from cuts by other branches of government in order to ensure an independent judiciary, they ruled. Judges and justices sometimes oppose actions by governors and legislatures.

The amendment to the constitution passed the state Assembly by a vote of 62 to 3 on Monday and swept through the state Senate by a vote of 28 to 0.

The New Jersey State Bar Association said last week that the amendment "represents a rash reaction... and a dangerous intrusion by one branch of government into the independence of another, co-equal, branch of government."

Judges must be free to rule objectively without fear of retribution, the association said.

And unlike other public employees and lawmakers, they are barred from earning extra money from outside work and are not covered by collective bargaining agreements, among other restrictions, the association noted.

Republican Governor Chris Christie said in a statement on Monday that he backed the amendment.

"Rarely has the public seen such unanimity between the legislative and executive branches that the judicial branch was dead wrong," he said.
